Peking University International and Comparative Law Review （PKUICLR）is an official publication of Peking University Law School， and it is the first academic joulTlal in the People's Republic of China specialized in international law and comparative law jointly．
PKUICLR welcomes manuscripts on current topics of interest to the international and comparative law community．PKUICLR dedicates a portion of each issue to showcasing student research in international and comparative law．We invite the submission of articles，comments，notes， recent development，case analysis，and book reviews in the field of international law and comparative law．

（4）返还和处分
公约第57条确立了对根据第55条没收的资产进行返还和处分的返还机制。首先，第55条参照1988年《联合国禁止非法贩运麻醉药品和精神药物公约》以及《联合国打击跨国有组织犯罪公约》相关条款规定，缔约国应当在没收腐败犯罪资产方面进行国际合作。即：在收到另一缔约国请求时，被请求国应当（在辨认、追查和冻结或者扣押位于本国领域内的犯罪所得、财产、设备或者其他工具后）：或者由本国主管机关直接没收，或者执行该请求国的没收令而没收。其次，在根据第55条采取没收措施后，应根据第57条确立的三种返还与处分机制进行处理。这一返还与处分机制的核心内容是确立了返还与处分资产的“原则”和“程序”。
返还与处分的“原则”是：采取没收措施的缔约国应当同时根据公约和该缔约国国内法处分被没收的资产，包括返还合法所有人，在考虑到善意第三人权利的情况下向请求国返还被没收的资产。
返还与处分的“程序”是：分别三种不同情况作不同处理：对贪污的公款或对贪污公款的洗钱行为，基于请求国的生效判决返还请求国；对其他犯罪所得而请求国能证明其合法所有权者，基于请求国的生效判决返还请求国；除上述两种情况（即贪污公款和请求国证明其合法所有权）以外的所有其他情况，优先考虑返还请求国、返还原合法所有人或赔偿犯罪受害人。上述生效判决的要求在一定情况下（如因罪犯死亡、潜逃或者缺席无法起诉以致无法获得生效判决，或者在其他适当情形下）应当由被请求国放弃。[7]
除上述原则和程序外，允许被请求国在返还或处分资产以前先行扣除为侦查、起诉或审判程序而发生的合理费用，并且允许缔约国就被没收资产的最后处分作出其他双边或多边安排。
